NOTWITHSTANDING THE FOREGOING, IN ANY CASE WHERE LIABILITY CANNOT BE EXCLUDED, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO PAPA GINOS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

You agree not to settle any matter covered by this indemnification clause without our prior written consent.
9. Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the state in which Papa Ginos is registered and operates, without regard to its conflict of law principles or provisions.

The arbitration shall be conducted in English and shall take place in the United States. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. 10.3 Class Action Waiver
10.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights, or to prevent imminent harm, pending the outcome of arbitration. Additionally, either party may bring claims in small claims court if the claims qualify and remain in such court.
10.5 Time Limitation
Any Dispute arising under these Terms must be brought within one (1) year after the cause of action arises, or such Dispute will be permanently barred. This limitation does not apply where prohibited by applicable law.

Cross-contamination may occur in our kitchen environments despite our best efforts to maintain separation between allergen-containing and allergen-free products. We cannot guarantee that any menu item is entirely free from any specific allergen, including but not limited to nuts, dairy, gluten, eggs, soy, shellfish, or other common allergens.
The nutritional and ingredient information provided on our Website is for general informational purposes and may not account for all variations, substitutions, or preparation differences. We disclaim liability for any adverse reactions resulting from undisclosed allergens or inaccurate nutritional information to the extent permitted by law.
16. Severability
If any provision of these Terms of Service is held to be invalid, illegal, unenforceable, or in conflict with the law of any jurisdiction, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired thereby, and such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be deemed severed from these Terms.
The failure of Papa Ginos to enforce any right or provision of these Terms shall not be construed as a waiver of such right or provision, unless such waiver is expressly made in writing and signed by an authorized representative of Papa Ginos. A waiver by Papa Ginos of any default shall not constitute a waiver of any subsequent default.
These Terms, together with our Privacy Policy and any other legal notices or policies published by Papa Ginos on our Website, constitute the entire agreement between you and Papa Ginos with respect to the use of our Services, and supersede all prior or contemporaneous communications, agreements, and understandings, whether oral or written, between you and Papa Ginos concerning the subject matter hereof.
